1. Acceptance of Terms
By creating an account or using BrainCandy in any way, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use BrainCandy.
2. Description of Service
BrainCandy is a free brain game platform where users can play daily cognitive challenges, track their progress, compete on leaderboards, and engage with a community of players. We offer both free and premium subscription tiers.
3. User Accounts
To use BrainCandy, you must create an account. You are responsible for:
- Keeping your password secure and confidential
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access
- Providing accurate account information
You must be at least 13 years old to create an account. One person may not maintain multiple accounts.
4. User Content
BrainCandy allows you to post content such as messages, comments, and reactions ("User Content").
- Ownership: You own your User Content.
- License: By posting, you grant BrainCandy a non-exclusive, royalty-free license to display, distribute, and use your content within the platform.
- Responsibility: You are solely responsible for your User Content.
- Prohibited content: No illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable content.
5. Prohibited Conduct
You agree not to:
- Spam — mass unsolicited messages, repetitive posts, or promotional content
- Harass — bully, threaten, or intimidate other users
- Cheat — use bots, scripts, exploits, or any means to artificially inflate scores or XP
- Scrape — automated data collection, crawling, or API abuse without permission
- Impersonate — pretend to be another user, BrainCandy staff, or any person
- Interfere — disrupt or attempt to harm the platform's infrastructure or other users
Violations may result in account suspension or permanent ban.
6. Premium Subscription
- Billing: Premium is billed on a recurring basis (monthly or annually) at the rate displayed at the time of purchase.
- Cancellation: You may cancel anytime from your account settings. Cancellation takes effect at the end of the current billing period.
- Refunds: We do not offer refunds for partial months or unused subscription periods.
- Price changes: We will notify you 30 days in advance of any price changes.

To the maximum extent permitted by law, BrainCandy and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of California.
10. Changes to These Terms
We reserve the right to update these Terms at any time. We will notify users of significant changes via email. Continued use of BrainCandy after changes take effect constitutes your acceptance of the new Terms.
